Question 6 does not mention minors or parental notification. The proposed constitutional amendment would establish a fundamental right to abortion until fetal viability. It would allow the state to restrict that right only to protect the health of the person seeking care, and only through the least restrictive means.
Nevada's 1985 law requiring parental notification or a judge's approval before a minor's abortion had been blocked in federal court before a federal district court judge let it take effect in 2025.
In May 2026, the Nevada Supreme Court unanimously ordered a lower court to block the law again, ruling it was likely unconstitutionally vague. Assm. David Orentlicher (D-Las Vegas), a UNLV law professor, said Question 6 would not interfere with a new law that lets minors seek a judge's approval instead of notifying their parents.
Voters approved Question 6 in 2024. It must pass again Nov. 3 to take effect.
